United Parcel Service Fires 250 Drivers

What did UPS deliver two weeks ago? Pink slips. To 250 employees. 

UPS fired a longtime union activist in Maspeth, NY, without the fair hearing he was entitled to. When word got out, 250 other drivers walked off the job in solidarity. 

Now UPS is retaliating. They sent a termination notice to all 250 drivers who participated in the protest. In other words, "You're fired." 

I wrote a petition that now has over 11,000 signatures to tell UPS that firing their workers for protesting is wrong.

The well-being of these drivers and their families hangs in the balance because they spoke out against a company that violated workers' rights. UPS shouldn't ship pink slips to their drivers out of retaliation. What should have been a routine disciplinary matter became an attack on hundreds of working families. 

Today, the drivers are committed to negotiating a fair resolution -- why can't UPS do the same and take back the notices of termination? 

What can brown do for you? Certainly not this. 


Tell UPS that firing 250 innocent drivers is the wrong turn for their employees, their brand, and most importantly, their customers.

it is called "job abandonment" and is not a termination...it is a voluntary quit. Whoever suggested this course of action to those drivers should be horsewhipped...there is a grievance procedure to handle the original termination and some very critical case history to acknowledge that the other 250 did abandon their jobs........without going into the right or wrong of the original termination it was irresponsible to walk off before the contractual remedy was allowed to handle the situation.....read your Labor Agreement...no arbitrator will reinstate those drivers....and now you have put 250 employees jobs at the mercy of the employer....totally irresponsible.

You've outdone yourself, Farley.  You're truly an idiot and the only washed up former union rep who would even consider weighing in on an issue that they had absolutely no knowledge of!

 

What happened at Maspeth was not "job abandonment", nor was it a "voluntary quit". 

 

Article 8, Section 2 of the Local 804 Supplement clearly states:  The Union agrees that it will not cause or permit it's members to cause strikes of any kind, stoppages, or any other interference with any of the of the operations of the Company during the term of the Agreement, so long as the Company abides by the procedures prescribed for the settlement of disputes and differences and the decisions of arbitrators as provided in this Agreement.

 

The Company failed to abide by the prescribed procedures by terminating a driver for a non-cardinal infraction without providing him with a 72 hour hearing notice, a prescribed procedure.  UPS violated Article 8, Section 2 of the Local 804 Supplement and triggered the 2 hour work stoppage.  All 250 drivers are currently serving a "working termination" until a final decision is made or a resolution is reached.

 

I'm sure that UPS is appreciative for your support, Farley.  I'd be happy to get a picture of those 250 drivers wearing their "Chuck You Farley" tee-shirts.  Yep...you're a real working class hero, Farley.

So Farley.... what do you have to say for yourself?  I was once terminated for job abandonment.  The termination was not valid because I was not issued a warning letter.  I don't know how the contract reads now. It seems to me that it is reasonable to warn an employee before terminating them for not showing up for work.  Then there is the matter of Article 8, Section 2 of the Local 804 Supplement.

Wow...Fartley, you have really outdone yourself, along with "2 before Midnight" and all the other Hoffa cheerleaders. This is called (as I'm sure you and all the other loyalist's have forgotten) BALLS. Evidently, our brothers and sisters at Brown just don't quite think Fat Boy's cutting the proverbial mustard, as usual. so let's see where this leads...Hey, ya think we can blame Ron Carey for this ? I know he's been dead for quite awhile, BUT, a scapegoat is a scapegoat...Just saying. I'm in Tank Haul, and I've already been lubed up to get ready for yet another **** contract. Even though I work for a multi-billlion dollar, extremely profitable corporation. So go ahead...Blame it on the members...You will anyway.

apparently all of you toodle-losers cannot handle the truth. When you refuse to do the work your contract obligates you to perform, you have abandoned your job...........whether it is bobo, shaman, or union578.you really should know better. I am certainly not taking up UPS's "side" just schooling you toodle-loser on Labor Law and the cases that define it....in fact an argument could be made that this insane idea actually empowered UPS because UPS can legally accept all 250 implied resignations and these folks will have to rely on UPS's compassion to retain their old jobs...not a good place to put yourself....remember how much Crooked Carey had to gift UPS from the central states fund in order to extricate himself from his illegal 70lb. strike?

NEW YORK (CBSNewYork) – Hundreds of UPS delivery drivers walked off the job in Queens on Wednesday morning.

The drivers from Teamsters Local 804 in Long Island City stood in the snow to protest working conditions.

Some chanted, “Stop the war on workers” and others yelled, “Stop harassment at UPS.”

 

In a statement, UPS confirmed some drivers delayed their dispatch because of a “personnel concern.”

UPS said the drivers have since resumed activity.

New York, NY - Hundreds of UPS drivers and warehouse workers walked off the job, Feb. 26, at the Queens hub in New York City.

 

The UPS workers from Teamsters Local 804, a local led by rank-and-file reformers, called an impromptu wildcat action to fight back against the unjust firing of a driver and vocal Teamster fighter. UPS management in New York resorts to firing workers on trumped up and nebulous charges in an attempt to weaken the union.

 

The company abuses the grievance procedure to delay worker reinstatement and back wages in these cases of unjust firings, attempting to ‘starve’ workers who stand up for their rights on the job into submission.

 

The strategy backfired. Workers fought back to defend the union fighter who UPS unjustly fired. Hundreds stormed out of the building shouting “Stop the war on workers!” and “Shut down big brown!” The workers held an impromptu picket, gave speeches and chanted for the vast majority of the day.

 

A striker, who asked to remain anonymous to avoid retaliation, said, “We’re sick of the company’s harassment. They fire people with families and kids for no reason. It’s just wrong.” The strike demonstrated the union spirit of “an injury to one, is an injury to all!”

 

The strike inspired Teamsters from hubs in the other boroughs. Workers from the 43rd Street hub in Manhattan, as well as the Bronx hub, said many plan to organize support for the brave strikers who stood up to management and want to send a strong message that any further firings or retaliations will be met by overwhelming solidarity and unity.

Do all the other supplements and riders carry this same Article 8.2?  Is that an article that was negotiated by Ron Carey when he was the head of Local 804? 

 

Because we all know that Ken Hall, who never drove a truck or was even employed at UPS would have never gotten this creative.

sorry "who are you" that is an old freight concept that was negotiated by Jimmy Hoffa at the advent of the NMFA....and later given away by Ron Carey during his disastrous NMFA negotiations where he also cost the membership their medical and overtime protection......so the truth is Ron Carey had nothing to do with "striking to enforce grievance issues" language... except to give it up...but also remember when Carey looted the Local 804 treasury and, like Sgt. Schultz, claimed  "I know nothing"..

so in closing "who are you?" do not try to rewrite the sordid history of Ron Carey as long as there are some of us still living that remember the truth about MeFirst Carey and the jeopardy he put our Union into.!!!

No links = no credibility.  Anyone can spin a Fairy Tale.  The history of the labor movement is well documented.  Posting links to relevant material sets a good example.  May be that some of us have not yet learned how to use the computer.  I remember when Ron Carey could step into a phone booth and turn into Superman.  Now where is that link?

Here's an update on the situation:

 

Support Grows for Maspeth Drivers @ http://teamsterslocal804.org/
 

Political leaders, Teamsters and other unions are uniting behind the drivers at Maspeth and calling on UPS to meet with Local 804, rescind the terminations and reach a fair agreement so we can move forward.

foster_solidarity_0.jpgLocal 804 members are holding parking lot meetings and circulating petitions to support their brothers and sisters. These actions will continue throughout the week and will cover every building in the local.

In 2001, I wrote a story about a special tree in the Shell Ridge Open Space.  I shared the story with a few friends.  One of the friends was Daya Cramer.  Daya taught  a college preparation course in creative writing at a local High School.  The first story was written by one of her students.  It is about a class field trip to my home in Walnut Creek.  In October of 2001, approximately fifteen students from Daya's class were introduced to the mystical realm.  I learned later that they were "not the same" for the rest of the school year.  I don't know if they have all recovered or if they want to.

Like I said, the fools that called this "strike" have thrown 250 UPS employees to the mercy of UPS management....typical toodle-loser tactic.....

noscabs, that is the same type of working stupid toodle-loser tactic that was used to prolong the Diamond Walnut strike and bankrupt the strike fund, but considering it came from Local 804, a toodle-loser stronghold, I am not surprised. There are "intelligent" legal ways to get your point across ....the leadership has put these drivers in grave jeopardy .........how would you like to not have a single legal leg to stand on with your job at stake?.....When the toodle-losers get involved, the membership gets hurt.
