OK, here's the scoop...I'll put it in the category intended. Possibly a more seasoned Steward could offer advice in a concerted effort for Brothers and Sisters. Short version is:
1. Documents of skimming 401k not following Legal SPD. Legal SPD amended 10 times(conflicts with CBA) with no notification to those it affects. Union Members have not received SPD's and when Steward requests, gets written warning to stop requesting 401k information. SMM and SPD denied. (Same as denied to post IBT election notice). Finally supplied but no SMM, no previous SPD to compare to. So... is reduced employer contribution to 401k legal and what amount does Employer report? (Tax Fraud?)
2. Then did calculating and supplied document to employer and Union Officials of skimming Vacation pay of "gross" average pay f(reduced) for 3 years in conflict with CBA! (Which figure does Employer report? tax fraud?)
3. Grievances filed to make all union members whole for 401k and vacation pay and no response to either. (Except another written warning to stop with grievances and info requests)
4. Report to Union Officials, supply documentation, no reply. (Same response as when 22 Union Members weren't receiving ANY 401k contribution. Employer blamed ADP payroll services for error that time)
5. Report to DOL and they refuse to investigate.
6. Previous filing of charges with NLRB : give testimony and evidence for affidavit, privately tape record (legal in Wisconsin), NLRB supplies 48 pg. affidavit that does not reflect actual testimony AND omits evidence. Steward refuses to sign as it is not accurate. NLRB issues subpoena to give testimony again, to miss work for as loooong as it takes.Good ploy to get fired and loose pay. Offer original tape recording to NLRB to more accurately reflect testimony. Agent NOT happy! No such luck.... he keeps thumb drive (my personal property) and demands Steward delete ALL copies.Dismiss charges because Steward still refuses to sign bogus, manipulated affidavit under oath. Appeal goes nowhere either, Mr. Solomon denies as Steward was uncooperative. Only explanation given and charges (multiple) didn't warrant investigation.
7.Supplied Form 5307 showing false statement of "plan" NOT collectively bargained but it was. (Researced SEC filings) At this point, up to 8 written threats from Employer to discipline or terminate if Steward does not stop "harassing" and intimidating employer with grievances and info requests. Odd thing is... plant manager refuses to sign warning. Previous HR director fired that dealt with Steward. Sure is a lot of refusals to sign things going on!
Absolute power corrupts and corrupts absolutely.... isn't that how it goes??? Steward still working and fighting profesionally...... Now what???? Union Officials not backing Steward.... wonder why???. Fraud against union members and possibly against government.... what to do now as "Company Union" coverup.
8. ERD & EEOC still pending.....because Steward was suspended for 3 days, denied overtime for 12 weeks, suddenly not qualified to work in departments previously worked in, harassed and retaliated against and Union Officials threaten Steward to STOP accusing company of discrimination in grievances or Steward would be sued by Company for defamation. Union Officials won't allow mediation because "they have 6000 other members to worry about" and they decide if they want to spend the money.
9 Fax Gegare - No response. "Company Union" setting example of what happens to ANYONE that asserts protected rights. Quite costly for Employer attorneys according to fellow Steward that is also not happy about newer steward bringing 401k violation to light. So.... who is actually benefitting from this corruption??? Definitely not the workers. Steward is not going to quit fighting for Brothers and Sisters any time soon. It's a matter of ethics, principle, truth and what is RIGHT. Contractually due to workers. Not win or loose, or power, or politics. The RIGHT to receive what is EARNED by LABOR PERFORMED! ( So laborers can continue to pay Government taxes for services NOT rendered) What a viscious circle, with the workers loosing. Advice from fellow ethical Brother or Sister????
