631: AN OPEN LETTER TO BRO. JAMES P HOFFA

It's been four long, harrowing months since the Trusteeship Hearing of Local 631 in December. Those of us that have been at the forefront of standing up for the membership and our families have been through a very stressful time of waiting, struggling and continuing to stand up to the injustices that we have suffered and continue to suffer at the hands of the incumbents here. John Phillipenas & Co. have shown no respect for the process, for your Personal Representative Mike McElmury, for the IBT Constitution and our Bylaws, and (most importantly) for the membership and their families. The hearing was a "circus", a fact to which I am certain your Rep. and Panel Members have confirmed to you. The incumbents are truly an abominable stain upon the history of this Great Union and, certainly, some of the worst officers that a Local has ever had to endure.
Since the hearing, I believe that you have been informed of numerous acts of further retaliation, improprieties and malfeasance committed by the incumbents, probably on a weekly basis. Phillipenas has never expressed any contrition, regret or even second-guessed any of the blatant violations that have been the hallmark of his administration. While I'm not privy to when the transcript was furnished, I am certain that your decision regarding the question of Trusteeship will be communicated in a matter of days...
Having said all of the above, I want you to know that I still believe in you, Jim. I believe that, while I'm sure that you aren't perfect (who is?) you are, without a doubt, the best person to be "at the helm" of our Great Union. No matter what your decision may be regarding 631's future, I want you to know that I, for one, will be voting for you as our next General President. Does that mean that I will agree with your decision no matter what? Certainly not! I have expressed my opinion to you directly via letters, etc. on a number of occasions and that opinion has not changed. But will I stop supporting you because you decide upon a course with which I don't agree? No. And here's why...
In order to lead a body of individuals ruled by a democratic system, one must have the submission to one's leadership. And the only test of that submission is when those that are lead DISAGREE with a decision made by the leader. When one disagrees with one's leader, then their support of that leader is truly tested; in fact, that is the ONLY time one's support of a leader is really tested.
Brother Hoffa, I want you to know that, whatever decision you make, I will still support your leadership of the IBT. Does that mean that I won't avail myself of every legal means to challenge a decision with which I don't agree? Absolutely not! However, I will still support you as General President and I will vote for you in the upcoming election no matter what you decide. I believe this is how members of an organization ruled by democratic principles behave; and I think that you would have no objection to anything that I have expressed in this letter to you.
I believe you to be a fine, upstanding individual that has the best interests of the members of the IBT at heart, and no one can convince me otherwise. I will be in Washington, DC on Friday, accompanying my daughter to a scholarship competition there. If you are there in town, I would be honored to shake your hand on the steps of the IBT building; I'll even wear a suit and tie! Give me a call if you are available; I'll have my cell on. My name is Shirayne Waite, I have been a construction Teamster at Local 631 for 21 years. I am very proud of that and the fact that I come from a Teamster family. I am very sure that everyone reading this knows I am not happy with the ongoing developments at our Local 631. I have spoken with a great deal of construction Teamsters about how they feel about what has been and is currently happening in our trade, I have not found anyone that is even remotely OK with what has transpired since this administration has taken office. I have sent out a few letters of my dismay since this administration, and of course I find myself at it again. This letter I will e-mail to all Teamster address’ I have in my address book, along with JC42, Mr. McElmuray, and a hard copy will go out via certified mail to Mr. J.P.Hoffa. I feel the need to shout out as loud as I can to anyone that will listen; this administration is trying to destroy the construction craft from within by allowing the ready mix craft to take our work. To explain myself I will start from the beginning.
It began in the first two months of this administration taking office. Aggregate Industries presented them with a letter written on A.I. letter head that pretty much stated that the past administration gave them the right to take all of their construction Teamsters and send them to ready mix contract which meant close to a $13.00 an hour cut from their pay package. Without so much as picking up the phone to call the past administration and find out what really happened, this administration allowed it to go through, This letter that A.I. presented only had one signature-----Theirs---- needless to say almost two years later, hearings on this matter, A.I. was found in the wrong. What is very upsetting is present date we are having hearings to figure out a settlement for our Teamster brothers and sisters who lost TONS of money and this administration is not demanding back-pay for the money lost PER-HOUR of work! EVERYONE involved in this deal knew it was wrong when they first let it happen, why should we pay for their greed, and this administrations hatred for the past administration!
Then came July 2010, our construction contract opened and we had everything from backdoor negotiations, separate contracts, to our B.A. saying if we just ignore this we will get the year freeze we are looking for. At present our negotiations are robbing us of every decent piece of language that has been written in our contract. This is what our B.A. and John Phillipenaus told us at the most recent craft meeting; they have given the contractors our double time, 2 hours and time worked, all our zone pay, shift differential pay, make up day on Saturday, language on Davis Bacon, and they are trying to come up with language to change article 4 which I will have provided to you in an attachment. Article 4 is the backbone of our contract!!!!!!!! I can’t stress this enough. I have a perfect example of what it will do to our trade if they are allowed to change one letter in it. I work for a company that has a sub-contracted position on a huge freeway job, we have the road grade and pave portion of it. For the Last 4 months our brother and sister ready mix drivers have been doing our work, 7 to 8 loads a day dumped in the grade. Our B.A. seems to think because of a job over a year ago near searchlight had a similar problem and was grieved, and ruled on using term the one drop. Our B.A again did not put up a fight and allowed it. One drop is not even remotely in our contract, even if it was does 7 To 8 loads a day in the grade constitute one drop! After I and others had enough we made this administration actually read article 4, I realize this sounds a little out there that a B.A. would not have read this article but it’s true. We now have a grievance on this which I have sent to you, but that’s about as far as the B.A. went with it, last I heard the attorneys have it, while all of the construction guys have sat home, that’s if they haven’t lost their home! We have had several from our barn leave and seek employment outside of the Union because they are being held away from their jobs by our current administration. SAD VERY SAD Back to the contract the contractors not only want all that I have said they also want us to give up 9.55 per hour from our total package. I guess I am writing this as I always do to beg for some relief, help, brotherhood, SOMETHING! Construction is my LIFE as it is for my other brothers and sisters we don’t need our Secretary Treasurer showing up at the most recent craft meeting doing his bidding to get re-elected by telling the members about insurance, that where there find out the status of their contract, about how he intends to change the banked hours on our insurance to provide them more personal gain of their monies, and how as soon as the fund is at the right amount he will give back our Dental and Vision, which if I had to lay odds on it that would be just before voting in November in hopes of garnering more votes. We need the man at the top to give us hope, to prove to us he cares about our situation, and he has a real plan to get us where we need to be to live our lives and support our families; he has proven once again it’s his way or the highway! Sad to say most people in this trade may literally have to hit the highway.
Well I am very sure as soon as I send this I will have more to say! I want to thank all for their time and ask again to believe me when I say this is not an exaggeration this is just the very little that I am privy to.
