Last I checked, it was an open forum. He is allowed to post anything he wants as long as it is in the guidelines of this website. Same as you. The intrigue of this website is it's diversity. If all posts were the same, if all responses were pattered and predictable, you would not be here, neither would I or anyone else....except.... maybe ...TA.
Yes it is - An open forum presumably best served by the exchange of ideas, opinions and information. Of course the only thing you offer is YOUR opinion of a poster (TA) who is offering HIS opinion of another poster (Shaman). In that respect, what makes you better than the person you admonish? Rhetoric aside, Charlie has some rather obvious issues I really don't care to be displayed here. And if you took the time to read the 3 years of responses to his posts, you'd realize there are alot more people who also feel that way, than there are that think he has something useful to say.

Chuck, we've been through this before, remember? You said "I've never lost a grievance". How can the grievance panel be corrupt if you've never lost? As for issues, I've listed them many times before.
In this very thread you were caught lying in your own deposition. You posted personal and confidetial infromation of a fellow Teamster on the world wide web. You have continuously sang the praises of some voodoo cult that you have emersed yourself in that you go so far as to "only answer the phones". You willingly take the so called "tainted" cash from a Teamster pension. You are admitedly to sick in the head to perform the high stress job of carwasher. You threw a hissy fit when a feeder driver did the totally unthinkable task of applying his own rain-ex. Through your singlehand expertize of never losing a grievance you have managed to reduce the work force in your shift by half. You have failed to answer any dozens of questions about your outlandish remarks, an example of which would be, who are all of these reform activists who got fired and the trumped up charges against them?
Are you really so parinoid that you believe there is a "spokesman for the Teamsters" on this thread. Ofcourse your powers of peception are pretty keen, you do have me pegged as a BA from local 70 right? (super huge wide grin)

2. I am still concerned about the discriminatory application of unwritten company policies “under special circumstances”. This is my underlying concern and a primary reason I have filed these charges. United Parcel Service has refused to state their position in writing as to whether or not these policies exist on paper and or acknowledged that they exist in application. I believe that this is a reasonable request that would result in the resolution of item #1.
3. UPS has not yet responded to the information request that was filed on November 22, 1996 (copy attached) pertaining to the jurisdictional airport grievance. This grievance has not been resolved in over six months. I have attached an amended request for information relevant to this grievance.
4. I have not yet decided on my course of action pertaining to Mr. Naddy’s refusal to allow me to attend an off premises panel meeting. I am contemplating the filing of a grievance and a subsequent information request.
As a matter of record I am not on workers’ compensation at this time. I have appealed my workers compensation denial. My state disability was recently reinstated after I appealed.

Following is an amended list of information that I request you send to Local 78. This request is in addition to the original information request of 11-22-96 (copy attached). This information request pertains to the airport jurisdictional grievance that was filed last year and is scheduled to be heard at panel. I am filing this request in order to clarify jurisdiction and prepare for the grievance panel.
In addition to the specific items mentioned below, please supply all factual bases for your contention that the work in question does not fall under the jurisdiction of Teamster Local 78.
1. Bargaining notes and arbitration summaries that would clarify or supersede the published contract. I am referring to the National Master UPS Agreement, Northern California Supplemental Agreement and Northern California Sort Rider. I am looking for agreements allowing for the use of Local 70 employees to fuel equipment.
2. The dates and contents of any union statements upon which you are relying; and the dates and descriptions of any practices or events which you contend support your position. I wish to be informed in writing of the terms of the agreement which Ms. Muniz claims exists between Local 78 and UPS.
3. Copies of company memo’s and or correspondence that refer to the decision to use Local 70 personnel to fuel equipment at the Oakland Airport.
4. Job assignment records pertaining to the dates and hours spent by Local 70 personnel doing the work that is in question.
5. A job description of the Local 78 car washer that is currently working at the Oakland Airport and a job description of the Local 70 employee doing similar work at night.
6. The names and time keeping records of both the Local 78 and the Local 70 employees fueling equipment at the Oakland Airport. I am trying to determine the total number hours spent fueling, servicing and washing equipment by persons in both Locals.
7. Time study records and work rules covering the positions in question.
8. Please provide a list of vehicles fueled at the Oakland Airport. This list should include vehicle numbers, type of vehicle and a copy of the fuel reports for the past six months. This information is needed to determine the approximate work load at the Oakland Airport.
This request is made without prejudice to the union’s right to file subsequent requests. If any part of this letter is denied or if any material is unavailable, please provide the remaining items as soon as possible, which the union will accept without prejudice to its position that it is entitled to all documents and information called for in the request.
This request is being filed pursuant to Article 7, Section 1, paragraph (b) of the Northern California Supplemental Agreement. Please be advised that refusals to provide information, or delays in excess of twenty days, are unfair labor practices in violation of Section 8(a)(5) of the National Labor Relations Act.

Re: Oakland Airport Jurisdictional Grievance
The airport jurisdictional grievance was first brought up, formally, in the April 8, 1996 letter to Dan Varella (copy attached). Teamster Local 78 Business Agent, Dan Varella was approached by UPS Labor Relations Manager, Ms. Kim Muniz, in December. Ms. Muniz mentioned an unwritten agreement, pertaining to the Oakland Airport operation, between United Parcel Service and Teamsters Local 78. Mr. Varella told Ms. Muniz that he was not aware of an unwritten understanding and any agreement that wasn’t in writing was not valid.
I am of the opinion that this is the grievance that UPS management is most concerned about. This grievance has been delayed for over six months. UPS has not responded to an information request under the National Labor Relations Act. The hearing was delayed again in January. This grievance pertains to an eight hour job at the Oakland Airport. A decision in our favor would lead to at least one additional full time job and United Parcel Service would possibly be instructed to pay at least six months wages.
I believe that the filing of the airport jurisdictional grievance was a prime factor in the decision to issue the contractually unwarranted letter to terminate me dated July 15, 1996.

This letter is in regards to the new car-wash job at the Oakland Airport. It is my understanding that Local 70 is in the process of working out the details of job bidding and seniority at this location. I believe that Local 78 Teamsters are in a situation that is very different that of Local 70. Local 70 has members that are already employed at the airport whom the company can offer new jobs to on a seniority basis. Local 78 is in a very different position. We have, as you know, only one member at the Oakland Airport. The opening of a new car-wash position would necessitate either the hiring of a new employee, the transfer of a Local 70 part-time Teamster to a full-time position or the Company could offer the new Airport position to a Local 78 Teamster that is currently laid off at the Oakland Hub Facility.
I do not believe that offering the new full-time car-wash position at the Oakland Airport would create a precedent that would have implications for all Local 70 employees. We are in a unique position. We, unlike Local 70, do not have members at the Airport that new jobs could be offered to. I can’t imagine a valid reason to allow U.P.S. to draw from Local 70 to fill car-wash positions. I don’t believe it is in our best interest to abide by any panel decisions unless they specifically address our situation.
Please let me know, as soon as possible, what your position is on this matter. I and a number of other car-washers would like to proceed with a grievance worded specifically to our concerns if and when it becomes clear that such an action would be prudent.

The "issues" I refer to are you personal issues - number one of which is your obsessive behavior......whether it be over things you can't control, or more likely due to your failure to produce documented results on this site - things that don't exist. Of course, your allegations couldn't be a little off base, could they? It's must just be one big conspiracy.
But maybe I'm wrong. Maybe the Teamsters that visit this sight are extrememly interested in reading all of your documentation from about your personal situation from the previous millenium that has no effect on them, the IBT, UPS Teamster relations, the contract or their present and future situations. Maybe they've all ready Moby Dick and War and Peace several times each and find your posts enjoyable.

You know a QUESTION like......What kind of moron cut and pastes 10 year old documentation that never amounted to anything more than a public display of his obsessive behavior?
And an ANSWER like........The same moron who thinks, by simply writing a letter, that people he accuses of discriminating against him will readily turn over confidential information that the he, as the accuser has no legal right to, so that he may use it in attempting to substantiate his baseless charges.

U.P.S., Liberty Mutual, Kaiser and other parties involved did respond to my subpoenas and other requests for documentation. The response involved such a volumn of documents that I hesitate to post them here. Let me know if you would like a list.
You need to be patient. Most of the observations that you have made will be proven to be false. It's all in the documents.
I apologize for not posting more today. I have some other priorities.

You should have already received from the State of California your Qualified Medical Evaluator Panel Selection List. This notification is sent in accordance with Regulations of the Department of Industrial Relations and is intended to advise you of your rights and responsibilities in connection with the Qualified Medical Examination that you will schedule. If you have not already done so, please send us a copy of your QME panel list along with the name of the doctor you selected and the date and time of your appointment.
Attached is a copy of all the medical and non-medical information that is going to be submitted to the Qualified Medical Evaluator prior to your examination. You have the right, within 10 days of your receipt of this information, to object to any non-medical information. If we do not hear from you within 10 days, we will be sending all of the enclosed information to the Qualified Medical Evaluator.
If there is any information that you wish to furnish to the Qualified Medical Evaluator, you must furnish us with a copy at least 20 days prior to the date of your evaluation. We will then also have a right, within 10 days of our receipt of it, to object to any non-medical evidence.
The attached “Employee’s Permanent Disability Questionnaire” (DEU Form 100) must be completed and provided to the Qualified Medical Evaluator on the date of your scheduled examination. The Qualified Medical Evaluator will be forwarding the DEU Form 100 to the Disability Evaluation Unit for a Permanent Disability Rating. We will not be able to determine whether you have suffered from any permanent disability nor able to determine whether you are eligible for a permanent disability settlement without a rating from the Disability Evaluation Unit. We urge you to complete the enclosed DEU Form 100 form and provide it to the Qualified Medical Evaluator at the time of your appointment.

This letter is reference to our phone conversation today. I would like to clarify my position relevant to participating in the grievance panel scheduled in Monterey the beginning of next month.
I request a postponement of our hearing until United Parcel Service provides us with the documents that have been requested in pre panel discovery. If anyone involved in these proceedings has reason to believe that I am requesting documentation that either doesn’t exist or I am not entitled to, they should state so in writing.
I am not concerned with uncovering documentation that would compromise myself at the workplace. I am attempting to determine the truth. Given a choice between accepting an environment lenient to discrimination or being part of a workforce striving for mutual honesty and respect, I’ll choose the latter.
Again, please consider this letter to be a formal request to postpone the hearing of our scheduled grievances until United Parcel Service complies with our requests.
