Following is the latest lawsuit out of Oakland California. Oakland is the Hub of choice for discrimination lawsuits. UPS and Teamster Local 70 have worked together in creating an environment ripe for discrimination of every type.

Management and Teamsters are finally understanding that the problems must be addressed outside traditional channels.

SAN FRANCISCO (Reuters) - A *** Californian who has lived with his partner for 27 years sued United Parcel Service Inc on Tuesday, charging the world´s largest package carrier with illegally denying him a job transfer because he was not married.

The lawsuit, filed in Alameda Superior Court, claims the company discriminates against *** employees by not including them in a corporate policy that lets workers relocate to another city if a spouse is transferred.

"This case is about illegal, senseless and mean-spirited discrimination," said lawyer Jon Davidson. "UPS doesn´t have to let its employees relocate to stay with their families, but if the company offers this benefit to straight employees, it also has to offer it to *** employees."

Atlanta-based UPS was not immediately available for comment.

Longtime UPS employee Daniel Kline, who sought to join his partner in Chicago, seeks changes to the company´s transfer policy as well as unspecified punitive damages.

Plaintiff´s lawyers also said the case highlights how same- sex couples are hurt because while in some states -- such as California -- they can register as domestic partners, they are not allowed to marry.

Davidson added he did not know if the company had granted such transfers to unmarried heterosexual couples but said this did not matter because, unlike gays, they could legally marry and then take advantage of the policy.

Kline sued after his request for a transfer was approved at district and regional levels but denied by the corporation. The lawsuit charges this request was denied because the men are *** and therefore not legally married.

The lawsuit also accuses a UPS supervisor of illegally retaliating against Kline for pursing the transfer by saying that doing so could jeopardize his job.

The complaint comes after UPS last month agreed to pay a $10 million settlement of part of a class-action lawsuit charging that it discriminated against deaf workers.

In 2001, I wrote a story about a special tree in the Shell Ridge Open Space.  I shared the story with a few friends.  One of the friends was Daya Cramer.  Daya taught  a college preparation course in creative writing at a local High School.  The first story was written by one of her students.  It is about a class field trip to my home in Walnut Creek.  In October of 2001, approximately fifteen students from Daya's class were introduced to the mystical realm.  I learned later that they were "not the same" for the rest of the school year.  I don't know if they have all recovered or if they want to.

Another example of a country overrun with too many lawyers with too many boat payments.

Why should UPS recognize a *** parternership when the law does not? I don´t care if he´s been living with his grandmother or his great dane for 27 years. Why in the world, explain to us, should he be given a transfer, when he is NOT legally married to this partner? If it were a woman whom he had been cohabitating with, UPS would also have denied the transfer for the same reasons: NOT LEGALLY MARRIED.

Look, I don´t care who anybody sleeps with. But why do *** people think they should be accorded the same legal rights as married couples? Sorry, screw whoever you like, but don´t expect the law or corporate America to underwrite your sex life. I hope he gets his butt kicked into early retirement. And his lawyer eats the bill. :-Y

Someone thinks they have a strong case against UPS. I think that anyone should be allowed to transfer for a good reason. UPS is a big company. They need to work on their employee relations. Why not allow someone to transfer for any recognizable hardship.

A bunch of bigots are posting on Teamsternet. Bigots are good for something. The arms market would take a dive without bigots..

For those of you who don´t know, a bigot is "One who is strongly partial to one´s own group, religion, race, or politics and is intolerant of those who differ."

Sounds like Teamsternet, doesn´t it?

UPS thinks they are a government within themselves. They think they can do whatever they want even if it means breaking the law or going against their own policy. Money is the ONLY thing UPS cares about. UPS eats their own.

scb, if UPS obeyed the law, followed their OWN policy and respected our mutually agreed upon contract, there would be no need for lawsuits. But since UPS feels they are above the law, they do what they want in the name of greed. They get caught and get sued. If UPS would just play nice, they would be in court a whole lot less. And gee, think of the lawyer fees they would save!!

Hey, Dimmie, there´s no law that UPS must relocate a homosexual co-habitant. Meanwhile, they aren´t relocating ANYBODY unless there´s a need for them in the new location and a local candidate cannot be found.

UPS´s transfer policy has not kept up with the times. Not that I´m sugggesting I support any special rights for a *** employee over the rest of us. But, as an international business. One of the largest employers int eh nation... it would seem that mobility of the workforce would certainly be a great option to offer to the UPS employees. Especially in our soiety where most Husbands and Wives work.. if your counter part receives an offer for promotion to another city.. this causes great family stress. And, UPS may lose quality employees.

JUst makes so much better sense to have these options open for UPS employees.

How about some clarification. Domestic Partner refers to unmarried "straight" couples as well as *** employees. In the local paper UPS said (all of a sudden) that they do have a relocation poicy for domestic partners and the enrollment process is to begin in September.

UPS reverses on *** worker´s transfer

SUMMARY: Hours after being hit with a lawsuit, UPS said that a veteran employee can transfer from San Francisco to Chicago to remain with his partner of 27 years.


Just hours after being hit with a *** discrimination lawsuit in California state court, United Parcel Service (UPS) announced that a veteran employee will be allowed to transfer from San Francisco to Chicago in order to remain with his partner of 27 years.

Daniel Kline sued UPS on Tuesday with the aid of Lambda Legal Defense, after being denied a transfer that is routinely granted to employees who must relocate with their spouse.

Kline´s partner, Frank Sories, was reassigned to Chicago by United Airlines eight months ago, but UPS officials told Kline he did not qualify for the "Management Initiated Transfer Request" program that allows married staff to follow their husbands or wives to new cities.

On Tuesday afternoon, however, the company issued a statement explaining that Kline´s transfer was, in fact, approved, but that attempts to inform Kline´s lawyers had been unsuccessful. UPS also said it had already initiated a new policy that allows *** workers to transfer with their partners, but that the policy was to have been announced in September.

Lambda attorney Jon Davidson said a UPS official had indeed left a message after Davidson had left his office on Monday evening, but that he had not received it until after the lawsuit was announced on Tuesday. But Davidson added the message came after Lambda had written eight letters to the company and its lawyers, and heard only that Kline was "not qualified" for a transfer. On July 8, Davidson wrote a final letter giving UPS a July 18 deadline to transfer Kline or face a lawsuit, but received no reply. Although Davidson was pleased by the new developments, he said Lambda will need to understand the details before the lawsuit would be re-evaluated.

"The bottom line is that it sounds like UPS is going to allow Daniel to transfer, and going to make it possible for this couple to be reunited, and we´re happy about that," said Davidson. "And it also sounds like they´re changing some of their policies to get rid of discrimination against domestic partners, and we certainly welcome that as well."

But Davidson said it was "too early to tell" how the company´s new posture would affect the lawsuit. "We´ll have to wait until we actually see the transfer, see what kind of policies (UPS will establish) and see what they´re willing to do to make up for the last eight months."

Announcing the lawsuit Tuesday morning, Lambda said Kline´s transfer was initially approved on the district and regional levels, before corporate executives reversed the decision based on the fact that the two men were not married. Kline´s complaint also charges that a supervisor told him to get used to the idea that he would be staying in San Francisco or else prepare to be fired. Kline had also been harassed on the job, according to the complaint, and given less desirable assignments.

How can they "go against their own policy" ? Seems to me that if UPS makes a decision that contradicts prior policy that they are re-writing the policy. Are you suggesting there is something wrong with being flexible with policy? After all, IT IS NOT LAW - only a guideline that gives employees (and customers) an understanding of what is expected or tolerated, etc.

Dear JAFO,

The problem is that UPS changes their policies without notifying anyone of the change. They change their policies without communicating with management and without communicating the changes to the workers. This tendency is especially onerous when an employee is denied common sense decisions based on a policy that only exists in the moment. By this I mean that persons outside of a particular meeting are never made aware that a new policy has been created. This is because the new policy ceases to exist after the meeting is over.

I was threatened with termination for breaking a company policy that was never communicated outside our meeting. The policy didn´t exist in a policy book nor was it contractual. It was made up for the purpose of disciplining an employee that hadn´t broken the contract. It ceased to exist after the disciplinary meeting.

Such policies are discriminatory. They are something other than policy. They have no legal or rational merit.

UPS has acknowledged in writing to the National Labor Relations Board that there are no policies that its employees can be disciplined for violating outside of the Contract. I have the letter is my possession.

Policies must be communicated in order to be non discriminatory and valid. This would be extremely simple in the age of computers.

The problem is that UPS would like to maintain the flexibility to discriminate at will. They will continue to do so to the extent that such discrimination does not harm their public image, thus their profit. UPS does not have a soul. UPS has a pocketbook.

Not in the policy book, not in the contract and just "made up" for one meeting. Good luck trying to convince me that is a POLICY.

SOMETHING OTHER THAN POLICY - EXACTLY - NOT A POLICY.

I´d like to read the that letter. Do you think you can escape discipline for sexually harassing a co-worker? How about making a racist remark to a customer? The intentional destruction of UPS property? Think of ALL of the things that you know that employees HAVE received discipline for over the years that ARE NOT spelled out in the contract.

A policy does not need to be communicated to be valid. It SHOULD be communicated so that people will conform to it. If UPS WANTED to discriminate to maintain flexibility, they wouldn´t have policies AT ALL. They could take each situation, posture to judge it on it´s own merits, and discriminate at will. I´m sure you have an axe to grind and you may very well have been wronged, but your assertion that UPS makes up, changes or reverses policy discriminatorily just doesn´t hold water.

You can be terminated for breaking the law. The Contract or Company Policy do not supercede the law.

A policy needs to be communicated in order to be a valid policy. Otherwise it is a secret policy. The UPS Labor Relations Manager has stated, in a letter to the NLRB, that there are no policies outside the Contract that employees can be disciplined for violating. If there were, they would have to be negotiated. That is why we have contracts.

The following was written shortly after I was threatened with termination for violating a policy that didn´t exist.

I was threatened with termination for not making eye contact with my supervisor when notifying him that I was taking time off for a family emergency!

TO WHOM IT MAY CONCERN
Re: A Secret Company Policy

The following documentation pertains to questionable policies that have come to light following a meeting held August 29, 1996 regarding a discharge letter sent to me dated July 15, 1996.

Labor Manager, Kim Muniz and Automotive Division Manager, Paul Wartenbergh informed Teamster Local 78 Business Agent, Dan Varela, Alternate Steward, Ray Kindle and myself that the decision to issue me a discharge letter was based on a Company Policy that I was unaware of. We were informed that it is Company Policy to make eye contact with your supervisor as well as inform him or her of your intention to take time off at least 24 hours in advance. I am still not aware of all the circumstances under which Company Policy dictates that I must make said eye contact. Dan Varella, Ray Kindle and myself were not aware of this Company Policy. I am not certain if this policy supersedes the Teamster National Contract and pertinent Riders. Dan Varella specifically asked Kim Muniz if the Company Policy was posted anywhere in the building where the employee’s could read it. Ms. Muniz replied that the Company Policy was not in writing and acknowledged that I had no means of being aware of it.

I asked an immediate supervisor, Adolph Sanchez, on 08-30-96 if he could provide me with a copy of the Company Policy. Mr. Sanchez looked rather bewildered. He proceeded to tell me that he thought there may be some brochures and he thought that the Company Policy was mentioned during employee, management meetings. He then told me that he would try to get a copy of the Company Policy within a week. I don’t believe that he has ever seen a copy.

It is likely that the term “Company Policy†is an euphemism for “action taken outside the context of the contract.†Company Policy appears to be a broad term used to justify arbitrary action taken against an employee for reasons that can’t otherwise be justified.

I have repeatedly approached management with requests for a copy of the Company Policy only to be met with blank stares and vague answers to direct questions. As a shop steward I must be sensitive to the rules and regulations under which employees, including myself, are expected to work. Labor Manager, Kim Muniz, acknowledged on August 29, 1996 that the Company Policy does not exist in the form of a written document.

It is the companies position that I had violated a Company Policy that they admitted I had no means of being aware of. It was acknowledged that I am a good employee. Management has no valid complaints about my work but Company Policy dictated that specific action must be taken against me in a given situation. I was informed that there would be no exceptions to this rule.

I don´t have the time to go through over 2,000 pages of documentation. This does not include hundreds of pages of documents that other Teamsters have shared with me. I am also in posession of hundreds of pages of depositions.

I believe that the statement you would like to see was made my UPS Labor Relations Manager, John Naddy. It was in the context of a case other than mine.

You appear to be interested in my relationship with UPS. Please feel free to review my deposition in the Randy Olson Federal Lawsuit. I took a day to discuss my relationship with UPS in front of a court reporter, two attorneys for UPS and one attorney for the Teamsters Union. Randy Olson and his attorney were also present.

In 2001, I wrote a story about a special tree in the Shell Ridge Open Space.  I shared the story with a few friends.  One of the friends was Daya Cramer.  Daya taught  a college preparation course in creative writing at a local High School.  The first story was written by one of her students.  It is about a class field trip to my home in Walnut Creek.  In October of 2001, approximately fifteen students from Daya's class were introduced to the mystical realm.  I learned later that they were "not the same" for the rest of the school year.  I don't know if they have all recovered or if they want to.

Oh yeah, tho old secret "eye contact" policy. That´s between the "blowing your nose too loud" policy and the "hair parted on the wrong side" policy on the unwritten list of "secret" policies.

It does sound foolish, doesn´t it? I wasn´t aware of the "blowing your nose too loud" policy and the "hair parted on the wrong side" policy.

My Business Agent was stunned by the idiotic nature of my termination letter. Following is the letter he wrote to UPS.
