(UPS) and DHL Express that makes UPS the exclusive provider of air shipping for DHL's North American package delivery service.

The hearing also will focus generally on competition in the air shipping industry.

UPS and DHL announced their deal, a 10-year agreement, in May.

"A number of concerns have been raised regarding consolidation in the air freight business in general and the proposed consolidation involving DHL in particular, including the impact on jobs in the affected communities," Rep. John Conyers, D-Mich., the committee's chairman, said in announcing the hearing.

Conyers' announcement comes the same week that two senators called on federal antitrust regulators to take a close look at the deal.

On Monday, Sens. Herb Kohl, D-Wis., and Orrin Hatch, R-Utah, made their request in a letter to officials at the Juctice Department and the Federal Trade Commission.

The senators said the deal raised questions about DHL's ability to compete against UPS, and they said the agreement would have a "devastating financial impact" on DHL's current air transport providers, ABX Air and ASTAR.

UPS and DHL are the second- and third-largest overnight delivery services in the U.S., behind Fedex Corp. (FDX).

Protecting Work And Our Members At Dhl

The International Brotherhood of Teamsters and the Teamsters Express Division have committed to doing all that is possible to serve the best interests of our members who work for DHL. This follows the May 28 announcement that DHL would be restructuring by 'acquiring the services' of UPS, with the intent to provide transportation in its air network system for package volume in the U.S.

We are currently meeting with DHL to get clarification on what the restructuring means, how it will work on the ground and the potential effect it could have on our members.

We are involved politically in Ohio concerning any effect the restructuring has on ABX, DHL, and ASTAR, as we have members at all three companies. Local 1224 is a member of the official Economic Task Force for the DHL Hub in Wilmington, along with key community, labor and political leaders from Ohio city councils to Congress. The task force is working to present DHL with solutions that would enable the company to maintain the gateway in Wilmington, while addressing cost concerns. If this is not possible, the task force will assist in searching for new carriers to inhabit the DHL Air Park. The task force will be holding public meetings and keeping the community informed as plans progress.

Local 1224, representing the pilots at ABX Air; Local 100, representing the dispatchers at ASTAR; and Local 413, representing the auto-sort maintenance workers, have all been in contact with the employers to make sure that their members get the best deal possible IF their jobs are affected by the restructuring. The International Union and the Teamsters Express Division are assisting wherever possible in these negotiations and meetings. Any severance package offered by the affected companies to Teamster members MUST BE BARGAINED WITH THE TEAMSTERS UNION.

Full story here http://www.teamster.org/resources/dhlexpre...ageaboutdhl.asp

Some air freight will be shifted to UPS's Louisville hub this year, said Jonathan Baker, DHL director of public relations, with full transition to be completed by the end of 2009.

The fate of other segments of DHL's Wilmington business remains unclear. The Wilmington airport, which DHL owns, would remain open for now, as will the various facilities on site.

DHL said it has not decided whether it will sell the airport, the largest privately owned airport in the United States.

Wilmington is also DHL's largest ground sorting facility and is used to clear and sort international air freight. "We're studying what to do with those operations, whether to remain in Wilmington or go to alternative locations," Baker said.

DHL is a 49 percent owner of ASTAR, and is represented on ASTAR's Board of Directors. ASTAR crewmembers carry roughly 50 percent of the weight out of Wilmington, Ohio, each night for DHL.

"Any decision by DHL to circumvent its commitments to both ASTAR and ALPA would be a despicable act and a demonstration of this corporation's utter contempt for the many American workers who have devoted their careers to this company," said Captain Pat Walsh, chairman of the ASTAR pilots' union. "ALPA will do everything necessary to make sure that all aspects of these commitments are honored by both ASTAR and DHL."

Walsh also said that ALPA intends to investigate the decision-making process at DHL, which is leading to the absurd result of a company depending on its chief competitor for the most crucial aspects of its express operation. The union also intends to inquire into why the details of DHL's discussions with UPS apparently were intentionally kept from both ASTAR and ALPA during the negotiations between these parties -- negotiations which were carefully monitored and the results of which were approved by DHL.

ALPA has significant concerns that this course of conduct is completely inconsistent with DHL's legal responsibilities and will seek to have this matter investigated by appropriate government authorities.

Founded in 1931, ALPA is the world's largest pilots union representing 55,000 pilots at 40 airlines in the U.S. and Canada, including over 500 pilots at ASTAR. This includes:
- Station network rationalized by 34% via service center closures and consolidations
- Pickup and delivery routes rationalized by 17%
- Ground linehaul network rationalized by 18%
3. Targeted SG&A (sales, general and administrative) reductions of $130 million

Impact to Customers

- DHL will continue to deliver to 100% of the zip codes we deliver to today
- DHL will continue to pick up 99% of the volume we pick up today
- DHL will leverage partnerships for final mile for approximately 2.4% of current delivery volume to sparsely populated areas
- Overall, less than 4% of our current network shipment volume is impacted.
