I need a shout out from any california ups or other part time teamster who is being denied a timely rest/break period. I have a recourse for what is otherwise what we have come to take for granted...that we do not get a break if we do not work over 3 hr 45 min...this is a misconception that has been a part of both union and company bumbling...I will give the solution, and a guaranteed 15 minute break to any interested part time employee, but especially those in the ebay district. wdog

IF THE NAZI´S DIDNT GIVE BREAKS IN CONCENTRATION CAMPS THEN WHAT MAKES YOU BELIEVE THE MODERN DAY NAZI´S OF THE SHIPPING BUSINESS WOULD EVEN CONSIDER A HUMANELY DECENT THING SUCH AS BREAKS FOR THIER PT WORKERS THAT PERFORM 8 HRS WORK IN LESS THAN 4 HRS TIME FOR LESS THAN 2 HRS FAIR PAY. GET IN TUNE WITH REALITY AND THEN YOU WILL BE A CANDIDATE FOR THE NAZI YOUTH OR PT SUPERVISOR PROGRAM.

This is a tutorial. A later posting will only contain
the specific language you need to educate your BA and local union. Shame on them for not being educated on this matter!! By CA. state labor law you have the right to a paid rest period if you work in an occupation for 3 hours 30 minutes or above. PERIOD. The employer is not liable for this paid rest period if the employee´s work UNDER 3 hours 30 minutes (3hr29min and below) What is clear/chargable is that an employer can be penalized 1 hr per employee per occurance if this wage order is violated. first , go to this link: http://www.dir.ca.gov/iwc/ it is the ca. state office who´s responsibility it is to produce and describe californias labor code. there mission statement is as follows: "It is the continuing duty of the Industrial Welfare Commission... to ascertain the wages paid to all employees in this state, to ascertain the hours and conditions of labor and employment in the various occupations, trades and industries in which employees are employed in this state, and to investigate the health, safety, and welfare of those employees." on enforcement of these codes, look here: http://www.dir.ca.gov/dlse/dlse.html this is the department that ultimately presses action upon industry violators of the labor code.go here to file a claim: http://www.dir.ca.gov/dlse/HowToFileWageClaim.htm within these codes is the legal requirement for rest periods as well as other significant hours of work rights. don´t let ups´s vision of your rights be limited to the contract alone... you have many superior rights the company wishes you didn´t know about. these carry the weight of law and the threat of financial penalties for any industry in our state that does not comply. do you think that OSHA is the only state/federal department that has oversight, the threat of intervention and or penalty? I have information that can help workers reassert themselves in the workplace and with their local union, starting with this. First, if you are being violated in the matter of rest periods, educate your local union office about state laws that supercede and are superior to our contractual language. These laws are particular to callifornia, but that is the area of my own focus. any interested party with a little time on their hands can pour through their own state labor code to rectify workplace unfair labor practices. These may even surpass Californias hours of work conditions.Let me know. sduggesting that sice ups pt is such a bad deal you should quit is like saying America love it or leave it.. the real; response is if you dontlike it change it by voting no on any unacceptable contract,stiking,protesting ,informing the public of the rippoff etc. dont whine or run ,do somrthing constructive for reform.

In The San DIego hub- we always get our 15 min break. Sometimes they break it up like 5 min then 10 min but always 15 min.
I had a problem during Cristmas- But I fgrieved and got paid for time lost + some. My problem is the p/t employees to not work during their break..BUT today, for the first time supervisors recognized the problem and paid them for their time. Also the supervisors paid the early working employees. I didn´t need to file. What worked was explaining the quazi contracts to the supervisors. The fact that if the supervisor sees the employee working off the clock and does nothing to stop him/her, then the supervisor accepted the offer. With slience. |

What type of Hubs are you guys working at? At the Worcester Hub in Massachusetts, we get a 10 minute break between the 2nd and 3rd hour from the start of work. The entire building shuts down and no one works except the Combo job workers who are at the Wrap table (and are full time).

I am in the pre-load. we start at 3:30. I start at 3:45.
We work till about 5:45. Break time (15 min). ^ we have PCM sometimes the whole building. We used to get food every friday but new manager won´t allow it any more. We still get b-day cake once a month. Anyway- no one workes during break. Except those who are not in our local- such as the clean up and auto workers. |

In Vernon, Ca hub we are usually running 4.5hrs a day. We are only getting a 10 Min break. They pay or add 5 more min to the days shift. But what I found out was that not all get their 5 min. unless you know you supposed to get them.....leaves out the rookies sometimes.

... we have a 3 minute PCM before a 10 minute break every day, if we do not get our break then we are paid 10 extra minutes on our paycheck for not having it.
Also, around the time break usually occurs, everyone starts slacking and if we don't have a break and have a late break everyone gets reallly slow cause we are all ready to take a rest etc... kind of drains all your energy waiting for break. When the supes see that production just fell to the floor, they'll eventually call break. |

Belt starts at 4:20, I punch in between 10-15 minutes before, and get paid for it, PT sup brought it up, I told him to eat dirt, essentially I told Him, if he wants me to, I'll punch in at 4:20, follow my methods and get my area ready all while the belt is running away with my packages, he promptly shut up. javascript:emoticon(' We get a 10 minute break at 7am, seems to finally have settled into a pattern, our one P/T Sup hadn't been paying enough attention to much, and regularly pushed it to 715 or further. We finish between 8:30 and 9:30 Drivers start 9:15-9:30... Our break is paid time, some newer preloaders work through (I did it too) break cause they get so stacked out. But they aren't forced to work, All I do is take my sugary drink.. LOL and walk my cars and recount.. I hardly consider it work, and if I sit I get cold. We also used to get breakfast sandwiches from McD's or BK for a week of No misloads.... we haven't seen that in a while, not sure if its cause we had misloads or if the new center manager doesn't want to. But we had a box of donuts on monday..not sure who brought em. |

And our clock is set up so that you can punch in as early as you want, but it doesn't start counting until the set start time... |

Our break is paid time too, if we don't get it we get an extra 10 minutes of paid time though.
Our clock is also settup that no matter when you clock in, it start's you at start time. If your hub or center has those burbrowns then they can set them up like that too very easily, just a lazy supervisor on there part not doing it. |
